1. HOW TO ENTER: The Disney Parks "Cheers to Volunteers" Sweepstakes (the "Sweepstakes") starts at 8:00 A.M., ET on September 29, 2009 and ends March 31, 2010 at 11:59:59 PM, ET (the "Sweepstakes Period"). To enter, go to www.DisneyParks.com, click on the Sweepstakes banner ad and then register by completing and entering all of the requested information, including your name, complete address, (No P.O. Boxes allowed), phone number, valid email address and date of birth. After you have successfully registered, each day during the Sweepstakes Period that you visit the Sweepstakes website you will automatically receive one (1) entry into the Sweepstakes. You may also receive one (1) additional Sweepstakes entry each day by following the instructions in Rule 2 below to tell-a-friend through Twitter® about the Sweepstakes ("Bonus Entry"). Limit: One (1) Sweepstakes entry and one (1) Bonus Entry per person per day regardless of email address used. Other than on September 29, 2009 when the calendar day will be deemed to start at 8:00 A.M., ET, a day will be deemed to start at 12:00 A.M., ET and end at 11:59:59 P.M., ET of that calendar day. The computer of the independent agency administering the Sweepstakes, PrizeLogic LLC ("PrizeLogic"), shall be deemed to be the official Sweepstakes clock.
  2. "TELL A FRIEND": You may receive one (1) additional Bonus Entry each day during the Sweepstakes Period if you click on the button "Tweet® This" on the Sweepstakes website and post a message that can be read by your followers inviting them to participate in the Sweepstakes. You must have a Twitter® account; if you do not have an existing Twitter account, you must first establish a Twitter account. There is no charge to establish a Twitter account. Regardless of the number of Tweets you send a day, you will receive a maximum of one (1) Bonus Entry per day regardless of the Twitter account name or email address you use.
  3. RANDOM DRAWING & ODDS OF WINNING: On or about April 2, 2010, a random drawing will be held in Southfield, MI, USA to select the potential winners of the Sweepstakes (the "Winners") from among the total number of all eligible entries received during the Sweepstakes Period. The drawing will be conducted by PrizeLogic, and its decisions will be final. The odds of winning a Prize will be determined by the total number of eligible entries received during the Sweepstakes Period.
  4. SWEEPSTAKES PRIZES (5): Five (5) Winners will each receive a five (5) day/ four (4) night vacation package for the Winner and up to three (3) guests to the Winner’s choice of either (A) Walt Disney World® Resort or (B) Disneyland® Resort. (B) The Disneyland® Resort vacation consists of: Round-trip coach class air transportation for four (4) persons between the major gateway airport in the United States or Canada closest to Winner's residence and an airport in Southern California selected by Disney Destinations, LLC ("Sponsor") in its sole discretion, except that if a Winner resides within a 250-mile radius of the Disneyland® Resort, air transportation will not be awarded and no compensation or substitution will be provided for the difference in Prize value; Four (4) round-trip ground transfers between the arrival airport in Southern California and the Disneyland® Resort, except that if a Winner resides within a 250 mile radius of the Disneyland® Resort, ground transportation will not be awarded; Room accommodations consisting of one (1) standard room with a maximum of four (4) persons per room for four (4) nights at a hotel at the Disneyland® Resort (or similar hotel) selected by Sponsor in its sole discretion (subject to availability); Four (4) 5-Day Park Hopper® Passes; and One (1) Disney Gift Card with a face value of Two Hundred Dollars ($200) USD. TOTAL ARV of each Disneyland® Resort Prize: $4,376 USD; $4,747 CDN. NOTE: Regardless of Prize selected, all other costs and expenses not specifically mentioned herein including, but not limited to, meals, room service, laundry service, alcoholic beverages, local and long distance telephone calls, merchandise and souvenirs, taxes, tips and gratuities are solely the responsibility of each respective Winner and his/her guests. All taxes are solely the responsibility of the respective Winner. All travel must be completed by September 30, 2010 or the Prize will be forfeited in its entirety. Sponsor has no responsibility for a Winner's or guest’s inability or failure to utilize the Prize. Departure dates and accommodations are subject to availability, certain restrictions and blackout dates may apply. Winners and their guests must possess required travel identification documents and travel together on same itinerary. Canadian residents must have a valid passport and no impediment to enter the U.S. Guests must be adults in their respective state/province/territory in which they reside unless the Winner is their respective spouse/parent or legal guardian. Potential Winners will be required to sign and return a notarized Affidavit of Eligibility/Compliance including their Social Security Number as required for tax purposes (respective potential Winners who are residents of Canada must sign and return a Declaration of Compliance) and a Publicity/Liability Release, as allowed by law (the "Required Documents"). Failure to sign and return the Required Documents and other such requested documents by the return date specified in the Sweepstakes notification letter will result in forfeiture of the Prize and, time allowing, selection of an alternate potential Winner. Parent or legal guardian must sign all documents if a Winner or guest is a minor in his/her jurisdiction of residence. Each potential Winner will be notified by email, phone and/or mail on or about April 7, 2010. Vacations and vacation components may not be sold, traded, transferred, re-scheduled to dates not within the fulfillment period set forth above or refunded. Vacations are not redeemable for cash. Sponsor reserves the right in its sole discretion to substitute a Prize or a component of a Prize with one of equal or greater value. Limit: One (1) Prize per person or household address. TOTAL ARV OF ALL PRIZES TO BE AWARDED: NOT TO EXCEED $24,840.00 USD; $27,445.00 CDN.
  5. SKILL QUESTION APPLICABLE TO POTENTIAL WINNERS WHO ARE RESIDENTS OF CANADA: A potential Winner who is a resident of Canada will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time limited mathematical skill testing question, administered either by mail or electronically, as designated by Sponsor. If a potential Winner cannot be contacted and/or does not correctly answer the skill question within fourteen (14) business days of notification, s/he will forfeit the Prize and, time allowing, an alternate potential Winner may be selected in accordance with these Official Rules.
  6. ELIGIBILITY: All legal residents of the 50 United States including the District of Columbia, 18 years of age or older as of the time of entry and legal residents of Canada, over the age of majority in their province/territory of residence, as of time of entry, excluding residents of the province of Quebec, are eligible to enter the Sweepstakes except persons who are officers, directors, or employees (and members of household or immediate family, e.g. spouse, parent, child, sibling, step-parent or step-sibling and their household members) of Sponsor; its parent, related, affiliated and subsidiary companies; its advertising, promotion and web design agencies, including PrizeLogic; Twitter, and other individuals/entities associated with the Sweepstakes are not eligible to enter or win.
  7. LIMITATIONS OF LIABILITY/INTERNET: Sponsor; its parent, related, affiliated and subsidiary companies; its advertising, promotion and web design agencies; and their respective successors and assigns, directors, officers, employees, agents and independent contractors (all of the former collectively referred to as "Sponsor & Others") and all other individuals or entities involved in the creation, administration, or fulfillment of the Sweepstakes are not responsible for illegible, lost, late, incomplete, stolen, misdirected postage due, or undeliverable, email, or postal mail; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/web site/use net/Twitter accessibility, availability, or traffic congestion, or any technical error, or unauthorized human intervention, or the incorrect or inaccurate capture of registration information, or the failure to capture, or loss of, any such information. Sponsor & Others are not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to any website(s). By participating, each participant releases and agrees to indemnify and hold harmless Sponsor & Others from and against any and all costs, claims, damages, or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Sweepstakes, or arising out of participation in any Sweepstakes-related activity or travel-related activity, or the receipt, use or misuse, of any Prize, travel or activity-related thereto. Further Sponsor & Others shall not be responsible for any additional expenses, omissions, delays, re-routing, or acts of any government or other authority. Each Winner acknowledges that he/she is solely responsible for any actions, claims or liabilities of his/her guests related to any Sweepstakes activity including, without limitation, any actions, claims or liabilities related to the guests’ use of a vacation package or Prize. If, for any reason, the Sweepstakes is not capable of running as planned, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and/or proceed with the Sweepstakes in a manner deemed fair and appropriate by Sponsor including, without limitation, selection of Winners from among eligible entries received prior to said cancellation, termination, modification or suspension.   8. PRIVACY POLICY: Any personally identifiable information collected during an entrant's participation in the Sweepstakes will be collected by Sponsor and used by Sponsor in accordance with Sponsor's Privacy Policy as such is stated at http://disney.prizelogic.com/en/privacy.html
  9. PUBLICITY RIGHTS: By accepting a Prize, each Winner agrees to allow Sponsor and/or Sponsor's designees the perpetual right to use his/her name, biographical information, photos and/or likeness, and statements for promotion, trade, commercial, advertising and publicity purposes, at any time or times, in all media now known or hereafter discovered, worldwide including, but not limited to, on the World Wide Web and Internet, without notice, review or approval and without additional compensation except where prohibited by law.
  10. GOVERNING LAW: Except where prohibited, by participating in the Sweepstakes, participants agree that: (a) except as otherwise specifically set forth in these Official Rules, any action arising out of or relating to these Official Rules or the rights and obligations of any participant and/or Sponsor shall be filed exclusively in the U.S. District Court for the Middle District of Florida (or if the District Court shall not have jurisdiction over the subject matter thereof, then to the Circuit Court of the 9th Judicial Circuit in and for Orange County, Florida) and participants hereby consent and submit to the personal jurisdiction of such court for the purposes of litigating any such action, and any right to a trial by jury is hereby waived; (b) any and all disputes, claims, and causes of action arising out of or connected with these Official Rules, and/or the rights and obligations of any participant and/or Sponsor shall be resolved individually, without resort to any form of class action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Sweepstakes, and in no event will participants be entitled to receive attorneys' fees or other legal costs; (d) under no circumstances will participants be permitted to obtain injunctive or other equitable relief and a participant's sole remedy will be an action at law for damages to the extent allowed by sub-paragraphs (c) and (e) of this Section 10; and (e) under no circumstances will participants be permitted, and participants hereby waive all rights, to: (i) claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of pocket costs described in (c) above; and (ii) have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and/or Sponsor shall be governed by and construed in accordance with the laws of the State of Florida without giving effect or regard to any principles or doctrines of conflicts of law of the State of Florida or any other jurisdiction. If any provision or provisions of these Official Rules shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
  11. GENERAL: By entering the Sweepstakes, participants agree to abide by these Official Rules. In no event will more Prizes be awarded than are stated in these Official Rules. In the event that due to technical, mechanical or other errors, there are more potential Winners of Prizes than there are Prizes as stated in these Official Rules, a random drawing among the claimants will be held to determine the Winners. The Sweepstakes is subject to all applicable federal, provincial and local laws. In the event of a dispute as to the identity of a Winner based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor reserves the right to disqualify any individual found, in its sole opinion, to be tampering with the operation of the Sweepstakes; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of the Sweepstakes. Any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Sweepstakes will void any attempted participation affected by such methods and the disqualification of the individual utilizing the same. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
